Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the AIPIMetrics private beta (the "Service"). By creating an account or sending data to the Service, you agree to be bound by these Terms.
1. Who we are
AIPIMetrics ("we", "us", "our") is a software-as-a-service product that helps teams understand the business impact and technical performance of their AI-powered features through telemetry and aggregated metrics.
We may provide the Service through our affiliates or subsidiaries. Where we do so, we remain responsible for the provision and operation of the Service.
2. Private beta status
The Service is currently offered as a private beta. This means:
- Features may change, break, or be removed without prior notice.
- Downtime may occur and there is no guaranteed uptime or SLA.
- The product is not yet intended for critical or safety-related systems.
We may limit or revoke access to the private beta at any time, including by removing test data that you have sent to the Service.
3. Eligibility & accounts
You may use the Service only if you are able to form a binding contract with us and are not barred from using the Service under applicable law. If you are using the Service on behalf of a company or other legal entity, you represent that you are authorized to bind that entity to these Terms and that "you" refers to both you personally and that entity.
You must be at least 18 years old to use the Service. By using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You are responsible for maintaining the security of your account, including any credentials or OAuth identities you use to sign in. You are also responsible for all activity that occurs under your account.
4. Acceptable use
You agree that you will not:
- Use the Service for any illegal or unauthorized purpose.
- Send content that is unlawful, harmful, abusive, harassing, defamatory, or otherwise objectionable.
- Attempt to probe, scan, or test the vulnerability of the Service or its infrastructure.
- Interfere with or disrupt the integrity or performance of the Service, including via automated abuse or excessive load beyond reasonable testing.
5. Data you send to AIPIMetrics
The Service is designed to collect telemetry-level metrics about your AI-powered features, not the raw content of your end-users' prompts, messages, or documents. You should only send telemetry-level data (such as latency, errors, cost, and aggregate impact signals). You are solely responsible for the data you choose to send to the Service and agree not to use the Service to store or process raw prompts, user messages, documents, or other end-user content, except in aggregated or redacted form.
You agree not to intentionally send special categories of personal data (such as sensitive health, financial, or biometric data) unless we have agreed to this in writing, and in any case you must comply with the limitations above on telemetry-only use of the Service. Where personal data is involved, our Privacy Policy explains how we process it.
6. Ownership of data
As between you and us, you retain all rights to the data you send to the Service ("Customer Data"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and analyze Customer Data solely for the purpose of providing and improving the Service.
We may use aggregated and anonymized information derived from Customer Data to improve the Service, create benchmarks, and produce insights, provided that such information cannot reasonably be used to identify you or your end-users.
7. AIPI Score and metrics
The Service calculates an AIPI Score (AI Performance Impact Score) and related technical and business metrics based on the telemetry and configuration you provide. These metrics are estimates intended to support decision-making; they do not constitute financial, legal, or regulatory advice.
You are responsible for how you interpret and act on these metrics. We do not guarantee that any particular configuration, threshold, or metric will achieve a specific business outcome.
8. Availability, support & changes
Because this is a private beta, the Service is provided on a best-effort basis only. We do not guarantee continuous availability, and we may temporarily suspend or limit the Service for maintenance, security reasons, or technical issues.
We may update or change the Service at any time, including adding or removing features, adjusting metrics calculations, or modifying the user interface. Where changes are material, we will make a reasonable effort to notify you (for example via email or an in-app notice).
9. Fees
During the private beta, the Service may be offered free of charge for evaluation purposes. We reserve the right to introduce pricing in the future. If we do so, we will inform you in advance and give you the option to stop using the Service before any paid plan takes effect.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, secure, or uninterrupted, or that the metrics produced will be accurate or complete for your specific use case.
10.1 License to use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes and strictly in accordance with these Terms.
11. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the claim, or (b) one hundred (100) EUR.
12. Termination
You may stop using the Service at any time. You may request deletion of your account and associated Customer Data by contacting us.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms, or
- Continued access would create risk for us or other users.
13. Governing law
These Terms are governed by the laws of the Czech Republic, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of the Czech Republic.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. If changes are material, we will provide additional notice, such as by email or in-app notification. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
14.1 Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements or understandings.
